Hayward / Heyward / Howard

Continuing research into America's Colonial Era can bring one to uncover relationships that might never have been supposed to exist.  The possibility of my husband's New England Heyward / Hayward family being related in any way to my Old Virginia Heyward / Hayward line seemed such a small probability as to approach impossible.  Then while searching for references to my family in Dorman's "Adventurers of Purse & Person Virginia 1607 - 1624/25", I uncovered White / Hayward index entries from Concord, MA in this chronicle of Old Virginia.  Were my family and that of my husband's related?  Are these two Colonial families from the same English parentage?  Further information would be greatly appreciated.

To my son Henry, my housing and all & singular, land being 600 acres but if he dies without issue, then to my second son William. To eldest son, 1 young mare and 1 young negro named Cuttee, my check called the great chest and a copper kettle. To younger son William old gray mare. First two foals of above mares to go to wife Elizabeth and daughter Elianor Heyward. Cattle equally to wife & 3 children. Household stock to wife & 3 children. Wife to be executrix. Friends Mr. William Hay, Mr. Edward Mihill and Mr. Henry Tiler of Middle Plantation to be overseers of my will. Children to remain with my wife while she remains a widow, but if she married again and her husband is unkind to my children and abuses them, then the overseers to dispose them as they think fit. Upon petition of William Calvert and Margaret his wife, relict and executrix of John Heyward, decd, it is ordered that household goods & cattle of decd be divided into 4 parts, and relict to have 1/4 and 3 other parts belong to decedent's 3 children according to the will, which division will be made by Mr. Henry Freeman, Mr. John Willet, Mr. Thomas Mitchell and Mr. Charles Dunne, and the three parts household goods to be appraised and men to be sworn by Capt. Henry Gooch. Appraisement and division to be made 15 July next.

Charles Parish History and Registers, York County Virginia, Library of Virginia, Richmond Virginia (3rd Repring 1996) p. 9: "On reading this day in Council the Complaint of Henry Hayward, Senr., John Doswell and other Vestrymen of Charles Parish in York County against Thomas Nutting and others Vestrymen of the said Parish for opposing Mr. Thomas Cheesmans and Mr. Robert Shields voting in the said Vestry at the meeting appointed for advising of the repairing or building a Church. And upon hearing the allegations of both the said partys in Council this Board are of opinion that the present Constitution of the said Vestry is irregular and illegal. And for removing all differences that have or may arise in the said Parish by continuing the said Vestry It is ordered that a new vestry be fairly and legally elected and chosen by the Freeholders and householders of the said Parish...." p. 13: "The petition by Henry Howard, Edward Tabb, and others complained of an "undue and irregular election of a vestry for Charles parish on the 29th of June last past", because "votes of the parishioners were taken at their own houses twelve days before the day of the said Election and two days before publication of the order," and because of "diverse other irregularitys." p. 15: "The Council on February 18, 1708, took the case under consideration, and found "that the said election (of November 2, 1708) was fairly and regularly made according to Law, and the directions of this Board, and that it doth appear by the Return that Eleven of the said Vestrymen were chosen by a great Majority of the Inhabitants and it appearing also that there are two others returned who had an equal number of votes, It is the opinion of the Council that the Sherif amend his return by strikeing out one of them to make the number of the Vestry twelve and the return being amended accordingly. It was ordered that Henry Howard, Thomas Nutting, Thomas Chisman, Thomas Roberts, Robert Curtis, Henry Howard junior, Simon Stacy, Edward Tabb, and Anthony Robinson being duly Elected as aforesaid be sworn of a Vestry and that a Dedimus issue for that purpose directed to Robert Read and Wm. Buckner Gent or any one of them to administer to the said Vestrymen the Oaths and Test prescribed by Law for qualifying them for the said Offices."

In the name of God amen, the last Will & Testament of Henry Hayward of ye Parish of Charles in the County of York made on the 4th day of November in the year of our Lord 1811. I & unprofitable servant of God being strong and sound of mind & memory do willingly & with a free heart render & given again into the hands of my Lord God & Creator my spirit which he of the fatherly goodness gave unto me, when first he fashioned me in my mothers womb, making me a living and reasonable creature, nothing doubting but that for his infinite mercies sett forth in his precious blood of his dearly beloved son Jesus Christ my only Savior & Redeemer he will receive my soul into his Glory & grace in the company of heavenly angels & blesses saints. and as concerning my body even with a good will & free heart I give it over consigning it to the earth, whereof it came nothing doubting but that according to the articles of my faith at the great day of the great resurrection when I shall appear before the judgment seat of Christ I shall receive the same again by the mighty power of God, wherewith he is able to produce all things to himself, not a corruptible mortal, weak & vile body, as it is now, but an incorruptible immortal strong & perfect body in all points like unto the Glorious body of my Lord & Savior Jesus Christ. and as to my worldly estate which it hath pleased God to endow me with all I give & bequeath in manner & form following Viz. Wooten took up in & oak swamp to supply them all timber as they shall have occasion for it. The said land I give unto them to the heirs of their bodies and for default of such issue of either of them to return to the survivors in longest livers of them. Item my will is that I give to my son Wm Hayward four Negroes by name to wit Jnonss, Jimmy & Mall which negroes I give unto my said son Wm Hayward but if it should please God that my son Wm should depart this life before he attaineth to the age of one & twenty years then my mind & will is that the above negroes be equally divided between my son Francis Hayward & my said Jno Hayward. item I give unto my Jn Hayward Four Negroes by name Frank, Young Peter, Robbin & Sary and if it should please God that my said son Jno should depart this life before he attain to age of one & twenty years that then it is my will that the four negroes should be equally divided between my Francis & Wm Hayward. item I give unto my daughter Elizabeth Hayward two negro girls named Su & Jane with their whole increase, but if it should please God that my said daughter Eliza should depart this life before her marriage, that then it is my will that the negroes return to my daughter Anne Hayward and her heirs, for ever. item I give unto my daughter Eliza Hayward the first negroe which shall be born on the body of Nancy or Hannah my now negroe slaves be the same male or female which I give to my said daughter Eliza as aforesaid but if it shall please God that my said daughter Eliz should depart this life before marriage as aforesaid then my will is that the same shall return to my daughter Anne Hayward and her heirs for ever. Item I give &* bequeath unto my daughter Anne Hayward three negroes by name Kate, Jack & Cetty, but if it shall please God that my said daugher Anne shall not attain to the age of one & twenty years then it is my will that the three negroes return unto my said daugher Eliza and her heirs for ever. item my will & mind is that my loving wife Elizabeth shall have the care & trust of the being of my children until they come to age. And it is my will & I do hereby leave & ordain five negroes by name peter, Jack, Tom, Black Betty & Nanny for to work to maintain my wife & children, besides the profitt of my estates that I have left them as above but if it should happen my should marry before my son Francis Hayward come to age & if man that she marrieth should be unkind unto my children my will is that my son Henry Hayward, Jn Moss & Wm Moss, Ben Moss shall have the care & trust of my children & their estates until my son Francis Hayward shall come of age of one & twenty years. And then it is my Will & desire that my son Francis shall have the care & trust of the rest of my children & their estates until they attain to the age as above. item my Will & mind is that I do hereby give & bequeath unto my said wife Eliza Hayward & to my said children Francis Hayward, Wm Hayward, Eliza Hayward & Jno Hayward, Anne Hayward all my Estate to be equally divided between them. Deposition of Mary Avery, age 40, says that although she knoweth not the day of her birth, testifying she was at Mrs. Heyward's house in May 1654, Mrs. Heyward newly brought to bed, and this deponent being with child of her son William, and Mary Morley being also present, being with child of her daughter Joane Morley, ?tion was put as to which should be delivered first. mary Morley, ?ied that her reckoning was out in May 1654, this deponent going ?er, until 12 July 1654, on which date her son Willliam was born, ? is sure that the mother of Joane Morley was brought to bed before her. In the name of God amen, I Elloner Chisman of York county in Charles parish being of sound memory and understanding do make this my last will and testament in manner and form following. 1. George1 Heyward died 29 Mar 1671 in Concord, Middlesex Co, MA1,2. He married Mary. She died 12 Mar 1692/93 in Concord, Middlesex Co, MA3,4.

The History of Concord Massachusetts, Vol I Colonial Concord, by Alfred Sereno Hudson, p. 64-65. "The names of all the settlers who had reached the place of settlement by 1635 and 1636....Hayward....Some of the larger estates of these settlers are....George Hayward, 500 pounds...." p. 182, "Shattock says of the Hayward family: "The name has been written Heaward, Heywood and Howard, and although several now (1835) bear the last name, they all originated from a common ancestor. Heywood is a distinct name. George Hayward came here in 1635; died March 29, 1671; his wife died in 1693; estate 506 pounds; children Mary married Richard Griffin; John, Joseph, Sarah, Hannah, Simeon, George and perhaps other." The only records preserved among the vital statistics of Concord down to 1654, relating to the name as spelled either way are the following: "John the sonne of George Heyward was borne 20-10-1640. Joseph the sonne of George Heyward was born the 26-1-1643. Sara the daughter of Georg & Mary Heywood (this it is said should be Hayward) born 22-3-1645. Hannah the daughter of George & Mary Hayward the 20-2-1647. Simon the sonne of George & Mary Hayward the 22d-11-1648." The historian Walcott states: "The location of the first house lots of George Hayward and Michael Wood I have been unable to fix, but am inclined to believe that they were on the north and west sides of the Common." "George Hayward at an early date sold his house, barn and land near the mill pond to Mr. Bulkeley and built a house and corn mill at the southwest. John Heywood bought Thomas Dakin's house and barn."
