Winfield Family

Little is known of the history of John B. Winfield.  We know that he was born in North Carolina 1780-1790.  By the early 1800's he was living in the Abbeville District of South Carolina.  The "History of Lowndesville, SC" relays the following information:  "After the death of Samuel Hutchison, his widow, Elizabeth Hutchison, married second to John B. Winfield. They possibly had children. He had children by a prior marriage. They seem to have gone west to Mississippi."  We know nothing concerning most of their children, except for the sex and age brackets shown on census records.

This indenture made the fifth day of June in the year of our Lord one thousand eight hundred & twenty between John B. Windfield of the one part and Thomas Livingston Commissioner in Equity for Abbeville District of the other part, both of the District & State aforesaid - Whereas the said John B Windfield and Abe Houston - by their bond bearing date with these presents are held & firmly bound unto the said Thomas Livingston Commissioner aforesaid in the penal sum of nine hundred & thirty nine dollars nineteen & cents with a condition thereunter written that if the said John B Windfield do will & truly pay or cause to be paid unto the said Thomas Livingston Commissioner aforesaid or his successor in office or assigns the sum of two hundred & thirty four dollars seventy nine & a half cents on or before the third day of April one thousand eight hundred & twenty one and two hundred & thirty four dollars seventy nine & a half cents on or before the third day of April one thousand eight hundred & twenty two, then the said obligation to be paid ? now effect otherwise to remain in full forever & ? - Now therefore to the intent & purpose the better to receive the payment of the said sum of money. This Indenture ivitepeth that the said John B Windfield hath granted bargained sold & released & by these presents doth grant bargain sell release unto the said Thomas Livingston Commissioner aforesaid all that plantation or tract of Land containing one hundred & forty acres more or less - formerly the property of Samuel Hutchison decd & bounded North by James Hutchinson West by D Hutchinson, South by Capt Scott & East by Scott - together with all singular the appurtenances & heredinetaments thereunto belonging or in anywise incident or appertaining to have & to hold all things the premises before mentioned unto the said Thomas Livingston Commissioner aforesaid or his successor in office or assigns forever - provided nevertheless that - if the said John W Windfield & A Houston their being executors or administrators do as shall will & truly pay or cause to be paid unto the said Thomas Livingston Commissioner in Equity aforesaid or his successors in office or assigns the said several sums of money on or before the several day specified herein above & appointed for the payment thereof according to the condition of the above recorded bond without & ? as further delay & without any deduction defecation or abatement whatsover then this indenture to be void & of none effect otherwise to remain in full force & virtue in law. His son, James Kennedy Winfield, was born 1812 in South Carolina.  J. K. resided there, marrying his Anderson Co, SC sweetheart Sarah Sherard, until after the death of his father.  He then moved to Perry Co, AL, where relatives obviously lived.  This author has found several Winfield's in that area, but has not yet proven the relationship.  The family resided in Alabama until 1853, when they moved West to Mississippi with a group of friends and neighbors.  The "History of Leake Co, MS" relays a history of the move.  Based on the place names mentioned, it appears that James Kennedy Winfield did not join the wagon train until they reached Alabama:  "Traveling from North Carolina and Georgia, by way of Alabama, in 1853, fifteen families moved west. They set out with their families on ox-drawn Bow frame covered sheet wagons. They landed in Neshoba County, after looking over the surrounding country. They moved twenty miles farther west, into Leake County, to enter public lands which were open for them to choose. They settled in Madden. W.W. Thomas was their leader. His father was John Thomas."

James Kennedy Winfield spent the remainder of his life in Neshoba Co, MS, near the Leake County line, and is buried in Old Carolina Presbyterian Church Cemetery.

Know all men by these presents that John B Winfield of the State &District aforesaid for and in consideration of the sum of three hundred and fifty seven dollars, to me in hand paid for the receipt whereof is hereby acknowledged by James K Winfield of the said state, state and District have granted bargained sold and released unto the said James K Winfield a Tract of Land containing Sixty five acres (be the same more or less) also a Road fifteen feet wide leading from the said tract of Land to intersect the big road near the House that the said John B Winfield now occupies conveyed to me by James S Baskins on a part of the tract conveys to me by Baskins situated in the District of Anderson on Canoo fork a branch of Little Generostee adjoining Land by Lewis McCalester on the North & West and by John B Winfield on the South and I do hereby bind myself my heirs and Administrators to warranty and forever defend this the said premises unto the said James K Winfield his heirs and assigns against myself my Heirs and against Every other person or persons whatsoever Lawfully claiming or to claim the Same, any part Thereof. This indenture made the twenty th of January in the year of our lord one thousand eight hundred and forty two between Tarlton P. Moseley of the first part and James K. Winfield of the second part, witnesseth that the said party of the first part for and in consideration of the sum of seven hundred and fifty dollars to him in hand paid at and before the sealing and delivering of these presents by the said party of the second part the receipt of whereof is hereby acknowledged hath granted, bargained, sold and confirmed and doth by these presents grant bargain sell and convey unto the said party of the second part and to his heirs and assigns forever - The south west quarter of the south west quarter of Section No twenty in township no twenty one of Range No seven and the south east quarter of the south west quarter of section thirty in township twenty one of Range seven containing eighty acres more or less being situate and being in the district of lands subject to sale at Cohawba in the State of Alabama according to the official Platt of the survey of the said lands returned to the Genl land office by the surveyor general, which said lands were purchased by Abner Harbour from the general Government of the United States. Together will all on a Singular the tenements and appurtenances thereunto belonging in any wise appertaining unto also all the Rites Title interest claim or demand whatever of him the said Tarlton P. O. Moseley of the first part in their in law or equity of in and to the above bargained premises and every part and parcel through. Freeman Winfield of North Carolina & Perry Co, AL

James Kennedy Winfield sold his South Carolina land to and purchased Perry Co, AL land from Tarleton P. Moseley in 1842.  North Carolina native Freeman Winfield made that county his home.  After his 1839 death his widow and children remained in Perry Co, AL.  Did James Kennedy Winfield move to join family?

Freeman Windfield Will - The State of Alabama, Perry County
Know all men by these presents that I Freeman Winfield of the State and County aforesaid being very weak in my body but of sound mind and memory, do hereby make direct and constitute this my last will and testament and do revoke annull and abollish all other wills and testaments heretofore made by me. 1st I direct and will that my family have my boddy buried in a decent and Christian manner. 2nd I give and bequeath to my daughter Susan Daniel to her durging her lifetime and then to the heirs of her boddy the following named negroes to wit Nica, Matt, Richmond, Crissa and Tone. 3rd I give and bequeath to my daughter Mary Caroline to her during her lifetime and then to the heirs of her body following named negroes to wit - Sam, Harriet & Hubbert. 4th I give and bequeath to my daughter Margaret Elmira to her during her lifetime and then to the heirs of her boddy the following named negroes to wit Richard, Rachel and Peter. 5th I give and bequeath to my daughter Rebeca Morris to her during her lifetime and then to the heirs of her boddy the following named negroes to wit: Green Charity and Calvin. 6th I give and bequeath to son Hartwell Spain Winfield the following named negroes to wit Brandon Ceily and John together with five hundred dollars which I direct my executors to pay over to the legal guardian of Hartwell with in twelve months after my death the said five hundred dollars so that it may placed at interest for his benefit. 7th I give and bequeath to my daughter Martha Burress to her during her lifetime and then to the heirs of her boddy the following named negroes to wit - Dick Clary Cynthia & George. 8th I give and bequeath to my beloved wife Mary during her lifetime and then to be equally divided among my above named heirs the following real and personal property to wit all the plantation and lands with the appurtenances belonging to it - on which I now reside containing about nine hundred and forty acres also my stock of all description carriages household & kitchen furniture willing directing that that portion of the above property both real and personal which shall descend to my daughters shall rest and remaining in them during their lifetime and their heirs of their boddys. 9th I give and bequeath to my beloved wife Mary during her lifetime and there to be equally divided among my above named heirs the following named negroes to wit Gerbi Phillis, Liney Charles Richard Jane Hannah and big Charles willing and directing that that portion of the last mentioned negroes which shall descend to my daughters after my wifes death shall rest and remain in them during heir lifetime and then to the heirs of their boddys. 10th I direct that my executors hereafter appointed proceed as soon as probable after my death to collect all moneys that are due me or that may be coming due in their state also legacy which yet is in fact unpaid coming to me from my Fathers Estate in North Carolina. 11th I direct my Executors after paying my Just debts to place whatever moneys that may come into their hands at interest until each of my children may severally come of age or to their legal Guardian reserving always that portion which may fall to my daughters to go to them during their lifetime and then to the heirs of their boddys. 12th I direct and will that if my executors think it most advisable to hire out any of the negroes of my children that they do so until they may have legal guardians appointed to take care of their interest. 13th I having full confidence in my son in law - John Daniel and my brother in law William Burriss I hereby constituted and appointed them my Executors to carry into affect all the provisions of the foregoing will & Testament.
