State of North Carolina, Richmond County Superior Court. A Petition for Settlement. The petition of Richmond Cole, Executor of the last will and testament of Stephen Cole, deceased against George Cole, Mark Cole, Calvin Cole, Hiram Cole, the heirs at law of Stephen Cole, deceased, whose names are not known and who reside beyond the limits of this State, James C. Yates & wife Mary, Pleasant Ratliff & wife Martha, Amos R. Smith and wife Anne. (1) Your petitioner shows that he qualified as executor of Stephen Cole at April Term 1866 of the Court of Pleas and Quarter Sessions for the County of Richmond. (2) He further shows that the defendants above named are children of Stephen Cole, decd and are entitled to devises and bequests made in the last will and testament of their said father, Stephen Cole, deceased, his testator. (3) your petitioner shows that he has paid the debts due from his testator so far as came to his knowledge, where said indebtedness was just and proper to be paid. he further shows that he has filed his final account for settlement in the Court of Probate for the County of Richmond as the law directs. he prays that a final account and settlement be had with him as executor of said Stephen Cole which has been committed to his charge to the end that a final decree may be made in the premises. (4) Your petitioner shows that property disposed of in the will of his testator consisted principally of negroes and lands and that the negroes were emancipated before the death of the testator, Stephen Cole. Furthermore, that he has now on hand some personal property bequeathed to himself. (5) Your petitioner shows that Calvin Cole resides in the State of Mississippi as also does Hiram Cole, the heirs at law of Stephen Cole, decd whose names are unknown to your petitioner. that Ann Smith who married Amos R. Smith resides beyond the limits of the State of North Carolina, that Mary Yates and husband James C. Yates, and Martha who married Pleasant Ratliff reside in Anson County. That George Cole and Mark Cole reside in the County of Richmond. Your petitioner prays that a notice together with a copy of this petition be served on George Cole, Mark Cole, James C. Yates and wife Mary, Pleasant Ratliff and wife Martha, who reside in Anson County and that publication be made for Calvin Cole, ...this state for 6 weeks notifying them to appear at the Court house in Rockingham on the 12th Mon. after the 2nd Mon. in Aug 1870 and show cause, etc. and your petitioner will ever pray.
